Correction: Miskin drops Spartan from lawsuit

PETERBOROUGH, ON – Miskin law has reframed its class action commenced in the Peterborough Superior Court by discontinuing against Spartan Bioscience Inc., which was originally included, based on incorrect information provided to the law firm.
The defective tests cited originally did not use test kits of Spartan Bioscience. Murray Miskin now states: “We apologize to Spartan for involving them and we will proceed with the claim against Bio-Test Laboratories.”
Case Manor Care Community, a long-term care facility in Bobcaygeon, Ontario, remains Covid-19 free following retesting after false positive results had been given for staff and residents creating distress and hardship for people living at Case Manor and those who care for them.
Tests administered by Bio Test Laboratories, based in Ottawa, Ontario April 25 and 26, 2020 showed eight positive results from 13 people tested. Suspicions arose May 1, 2020 that test results were in doubt. New test results, from another lab, which came out on May 4, 2020 showed negative results.
Miskin Law was contacted on May 2nd by staff and has since been retained by a number of staff at Case Manor about their losses due to the false positive findings affecting themselves and their families. Miskin Law is proceeding in the Ontario Court with a Class Action lawsuit issued online on May 5, 2020 for the Superior Court in Peterborough against the lab.

On the evening of May 6th, we held a Zoom video conference call with 11 Case Manor staff and all three of our lawyers about the details of what happened and the court proceedings.”
Miskin Law may expand the lawsuit to include others in Kawartha Lakes and Peterborough who had false positives from the same round of testing.
